Tree2mydoor Youtube Terms and Conditions

1. These terms and conditions are the terms ("Terms") that apply to all Tree2mydoor channels on YouTube ("Site") and video submission process. By submitting a video ("Entry"), entrants (i.e. you) agree to be bound by the Terms.

2. In the event of any dispute regarding the Terms, conduct, results and all other matters relating to a video submission, the decision of Tree2mydoor Ltd shall be final and Tree2mydoor Ltd will not be required to enter into any discussion or correspondence.

Qualifying Entrants and Entries

3. Eligibility requirements for Entries are set out in the Submission Rules. By submitting a video, you hereby warrant that all information submitted by you is true, current and complete. Tree2mydoor reserve the right to verify the eligibility of all entrants.

4. You are not entitled to submit an Entry if you live in the excluded countries specified in the Sumission Rules or are under 18. Tree2mydoor assume that by submitting an Entry (and you warrant that) you are not resident in these specified countries and are aged 18 or over.

5. Tree2mydoor reserves the right to disqualify you if Tree2mydoor has reasonable grounds to believe you have breached any of the Terms.

6. You may submit as many Entries as you like provided they comply with the Terms. Entries must be made in the manner and by the closing date and time specified in the Submission Rules. Failure to do so will disqualify the entry. There is no purchase requirement to submit an Entry.

7. Proof of uploading, submitting or emailing a video cannot be accepted as proof of delivery or receipt of the Entry by Tree2mydoor. Tree2mydoor does not accept responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of or unauthorised access to videos, or videos lost, damaged or delayed as a result of server functions, technical issues, virus, bugs or other causes outside of Tree2mydoor's control. Tree2mydoor does not accept responsibility for the return of any Entries.

Intellectual Property Rights & Use of Entries

8. Tree2mydoor does not, unless agreed otherwise with you, claim any rights of ownership in your video. As such, you retain ownership of your video and, although Tree2mydoor will be able to use videos as set out in the Terms, you will also have the right to use your video in any way you choose.

9. In consideration of Tree2mydoor operating the Submission Process and agreeing to consider videos, you hereby agree that Tree2mydoor (and third parties authorised by the same) may make any and all videos available on the Site and any other media, whether now known or invented in the future, which may include other internet sites, mobile, television and/or radio and that videos may be made available with advertising and/or sponsorship. You now grant Tree2mydoor (and third parties authorised by the same) a non-exclusive, worldwide, irrevocable licence (for the full period of any rights in the video) to use, display, publish, transmit, copy, make derivative works or podcasts from, edit, alter, store, re-format, sell and sub-licence the video for such purposes.

10. Tree2mydoor does not guarantee to use or otherwise make available any video. Tree2mydoor may, in appropriate circumstances, and at their sole discretion, reject, edit, remove or disable access to videos that appear to be legally or otherwise problematic e.g. infringe the copyright or other intellectual property or privacy rights of others, are defamatory etc. or for any other reason.

11. Your video and any information submitted by you must be personal to and relate specifically to you. You hereby warrant that your video and all information which you submit and/or distribute will not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything which is libellous, defamatory, obscene, indecent, harassing or threatening and will comply with the Submission Rules. Tree2mydoor reserve the right, but not the obligation, to screen, filter and/or monitor information and/or videos provided by you and to edit, refuse to distribute or remove the same.

Liability

12. Tree2mydoor does not accept any responsibility for any damage, loss, injury or disappointment suffered by you as a result of submitting an Entry. Tree2mydoor is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment or software, failure of any email or video to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination of these, including any injury or damage to your any other person's computer or mobile telephone related to or resulting from participation or downloading any materials in the Submission Process. Nothing shall exclude Tree2mydoor's liability for death or personal injury as a result of its negligence.

Other Issues

13. You may be requested to take part in promotional activity and Tree2mydoor reserve the right to use videos in any publicity.

14. Any personal data relating to you will be used solely in accordance with current UK data protection legislation and the Terms and in accordance with any further details provided to you and/or consents obtained from you. Data relating to entrants will be retained by Tree2mydoor for a reasonable period after the Submission Process closes.

15. The Submission Process and Terms are governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England. The Site is only intended to be accessed from the United Kingdom and Republic of Ireland. Tree2mydoor make no representation that materials on the Site or the Submission Process are appropriate or available for use at other locations and access to them from territories where their contents are illegal is strictly prohibited. If you access the Site outside of the United Kingdom or Republic of Ireland, you are responsible for compliance with all local laws.

Tree2mydoor videos on Youtube - Rules

Tree2mydoor is asking for entrants to submit application videos on YouTube. You must make sure your application video complies with the rules below and by submitting an application video you agree to and will comply with the Tree2mydoor Rules, the Tree2mydoor online application terms and conditions ("Tree2mydoor Terms") and the YouTube terms (http://uk.youtube.com/t/terms and http://uk.youtube.com/t/community_guidelines ("YouTube Terms")). If you do not agree to any of these, please do not submit a video. The submission process is operated and managed by Tree2mydoor Limited. In the event of any conflict between the Tree2mydoor Rules and the YouTube Terms then, as between you and Tree2mydoor, the Tree2mydoor Rules shall prevail.

Any applicant who submits an application in breach of these rules may be immediately disqualified from the application process.

Applications - Process

1. First of all you will need to send your video to Tree2mydoor via the Tree2mydoor Yousendit account. You will find the link for this page here - http://dropbox.yousendit.com/Tree2mydoor.

2. Not all videos submitted to Tree2mydoor managed Youtube Channel's will be displayed and Tree2mydoor reserve the right to use and display on Tree2mydoor managed Youtube Channel's.

Application Videos - Important Requirements

1. You must star in your own video, but beside that it's up to you what you film, providing you follow our rules.

2. At the start of your video you can state your first name (NOT your surname) and reason why you are making the video. So for example, if your name is Andrew, you would need to say: "Hello, I'm Andrew and I want to propose to my girlfriend Sarah."

3. You must have the consent of all the people who feature in your video and they must all be happy to be published on Tree2mydoor managed Youtube channels.

4. Everything you submit must be your own work and not copied from anyone else. If you include anyone else's material in your video, you must have obtained their permission to do so. If you don't, you will be infringing the copyright in the material.

5. Do not secretly film anyone or infringe anyone's right to privacy.

6. Do not include anything that is obscene, indecent, harassing, threatening or liable to incite racial hatred.

7. Do not mention any court cases or arrests as this may constitute a contempt of court.

8. All facts in your video must be true and any opinions must be your own and genuinely and truly held by you.

9. Do not say untrue things about people or companies as this may be defamatory.

10. Do not feature any music in your video.

11. Other people will be able to view your video online, so don't reveal anything personal unless you're comfortable in doing so.

12. Your video must not exceed one minute in length.

13. You can use any means you have to film your video, whether it's with a video camera, webcam or phone. But the higher the quality the better. Make sure the lighting is ok and there is no background noise. We want to be able to see and hear you.

You and Your Information and Ownership of Videos

1. To submit a video via Tree2mydoor YouTube you need to be at least 18 years old and resident in any country where you can access YouTube (except Cuba, Iran, North Korea, Sudan, Myanmar/Burma, Syria, Zimbabwe and any other U.S. sanctioned country).

2. Tree2mydoor will not collect any personal information about you when you submit a video. If you are contacted by Tree2mydoor to take part in promotional activity you will then be asked to provide certain personal information and will be told how this will be used.

3. You will own any original content in your video but by submitting the application video you agree that Tree2mydoor may use it, copy it and make any part of it available on a Tree2mydoor managed Youtube Channel, other internet sites, mobile, television, radio and/or any other media channel in any format.
